TERMS & CONDITIONS

 

Thank you for your order: Please note your order will be produced as per this outlined invoing and the terms and conditions herein. Due to the custom nature of our product offering ALL SALES ARE FINAL once approved and signed off.

 

TERMS OF SALE

Residential: 1/3 Deposit

Commercial 1/2 Deposit

Balance is due upon completion and prior to releasing finished goods.

Interim payments may be required and is at the discretion of Abacus Furniture.

Consent is hereby given for deposit or payment due to be charged against the customers credit card.

Abacus Furniture Design shall retain title to merchandise until fully paid for by customer.

Customer is responsible for determining merchandise will fit through doorways, stairwells, corridors, and elevators.

Errors in pricing or arithmetic are subject to correction and collection.

The list prices shown, as well as those quoted, shall be Canadian dollars for orders shipped to destinations in Canada.

Not included is special or export packing, freight, unpacking and installation.

Client is responsible for reviewing, approving, and signing off on all details above.

No changes can be made on product currently in production.

Any changes made after signoff require re-quotation, fees associated, and corresponding changes to “due date”.

Delivery is not included unless otherwise quoted.

Installation is not included. If required, please contact for installation quote.

Storage charges will be assessed for merchandise at $25/square foot per month.

Please note every effort will be made to ship your items by the “estimated due date”. Delays may be caused by factors outside of our control, such as late arrival of custom ordered raw materials, material shortages, COM not being properly tagged, approvals of stains/drawings/etc.

Abacus products are portable furniture and as such may be subject to local fire, electrical and/or building codes applicable to portable furniture. However, since local codes vary from area to area, the Customer is responsible for the proper application of Abacus items within the limitations of local codes.

 

WARRANTY - Furniture manufactured by Abacus is warranted for one year to the original purchaser of the original address against manufacturer’s defects.

Repair or replacement is at our discretion.

Furniture and accessories manufactured/subcontracted by other companies shall have only those warranties of the manufacturer or subcontractor.

Warranty service to these products shall be at the discretion and rendered by the manufacturer.

Original bill of sale must be presented for warranty or service.

Warranty applies only to furniture subject to normal use and not to defects that are the result of negligence, misuse, or accidents.

 

SERVICE POLICY - Our policy is to remedy warranty problems as quickly as possible but sometimes delays are unavoidable.

Obvious defects or damage must be reported immediately of receipt of goods.

Transportation/Shipping is not included for repairs, touchups, service.

Service Call + Travel Time @ $145.00 per labour hour + materials + HST. Minimum of 2 hours may be applicable.

We know your time is valuable, and ours is too. Out of respect for our staff and our other clients, we ask that you give us at least 2 working day notice if you need to cancel an appointment. Missed appointments incur a $280 + HST fee.

Touch ups are not covered by warranty and may be done by Abacus or outside vendors at an additional charge.

Completed items are expected to be picked up or shipped in a timely manner. Any completed items that remain on premises for longer than 14 days will be assessed storage fees.

 

DELIVERIES - We know your time is valuable, and ours is too. Out of respect for our staff and our other clients, we ask that you give us at least 2 working day notice if you need to cancel an appointment. Missed appointments or cancelled deliveries made after the 2-day allowance will be assessed associated fees or a second full delivery fee.

Delivery personnel require a clear path through your home or business and to the intended location.

All present furniture must be removed by the customer.

Snow and ice are to be removed from driveways and walkways.

Abacus or its agents shall not be liable for damages caused to customers property or furniture.

Audio, visual, computer & electrical equipment to be installed by customer only.

Balance Payment is required PRIOR to releasing finished goods. If Balance Payment is not received prior to set delivery date a second delivery charge may be issued for loss of time, resources, storage, etc.

 

LATE DELIVERIES - Delivery dates shown are estimated and are approximate and take effect once drawings/invoice are approved.

Delays in custom furniture will occur and is an industry wide problem that is difficult to control.

PICK UPS - Pick-ups are Monday to Thursday 10am - 4pm, Friday 10am - 2pm, Saturday and Sunday NO PICK UPS.

Customers to provide their own packing materials and inspect the product prior to loading.

Damage incurred on pick up by the customers own transportation is not warranted.

Customer to inspect goods before loading, damage after inspection is not warranted.

Blanket wrapping, crating, and preparing items for pick-up is in not included.

Abacus is not liable for any damage caused by a client’s own transportation arrangements.

Products shall be shipped F.O.B. point of shipment, freight pre-paid and charged to customer, unless otherwise stated on a special quotation.

Delivery shall occur and risk of loss or damage to the product shall pass to the Customers F.O.B. point of shipment.

Customer is responsible for filing claims with the carrier for losses or damage to the product occurring during transit, including concealed damage.

A shipping surcharge of 8% of the list price will apply and be added to the order unless otherwise quoted.

Remote Areas: For shipments to locations 200km outside of an urban area of 250,000 occupants or more, additional freight charges may apply.

 

INSTALLATION - Installation is not included. If required, please contact your sales agent for installation quote or list of recommended contractors. Abacus Installation fees + Travel Time start @ $145.00 per labour hour + materials + HST. Minimum of 2 hours may be applicable. We know your time is valuable, and ours is too. CANCELLATION POLICY- Due to the custom nature of our product offering all sales are final once approved and signed off.

Orders are non-cancellable and non-refundable. ALL SALES FINAL.

We reserve the right to cancel any order at any time.

After one year from date of purchase, orders not completed due to customer delay shall be considered cancelled and deposit non-refundable.

Except as expressly set forth herein, customers may not return any products without written consent from Abacus Furniture. All returns are subject to a minimum of a 25% restocking fee / handling fee.

 

STORAGE - In the event Customer requests postponement of delivery beyond the acknowledged shipping date, after the products have become work in progress, or at the time when Abacus is then about to make shipment, Abacus may transfer the products to storage for Customer’s account and at Customer’s risk and expense. Such transfer to storage shall be deemed delivery to Customer for all purposes, including invoicing and payment.

Completed items are expected to be picked up or shipped in a timely manner. Any completed or postponed items that remain on premises for longer than 14 days will be assessed storage fees.

 

 


 

WOOD FURNITURE

All solid wood furniture will expand and contract with changes in humidity.

Try to maintain humidity of around 35 throughout the year.

Avoid placing furniture close to heat sources and in sunlight, this may cause discolouration, warping or the finish to crack.

Use place mats or trivets when utensils are placed on the wood surface.

Do not place hot items directly on surface.

Do not use nail polish remover, hair spray, perfume, or other petroleum-based products near the furniture.

Rubber or plastic products can sometimes cause a chemical reaction, which may deteriorate the finish.

For daily clean up, use a soft, damp cloth to remove dirt and accumulated dust.

Crack lines in knots, checks, or tear out in wood, and unusual grain patterns are part of nature and are not considered defects. Furniture in the sunlight or near heat sources shall have no warranty.

Abacus does not warranty minute flaws or marks discernible only upon the closest examination.

“AS IS” and “FLOOR MODEL” sales are final and no warranty will be extended, nor can these pieces be returned.

Unfinished wood furniture is not warranted.

Warranty is null and void if petroleum-based products (polish) is used on furniture.

Furniture and accessories manufactured by other companies shall have only those warranties of the manufacturer.

Warranty service to these products shall be at the discretion and rendered by the manufacturer.

STAIN AGREEMENT - Natural characteristics of woods, grain and density, age of wood and colour, humidity and temperature will cause colour to vary. We do not guarantee colour matching.

I will accept a colour/grain match as close as possible, and I realize that the match may not be exact.

 

 


 

SOFT SEATING – UPHOLSTERY

C.O.M – Customer’s Own Material - Abacus will determine whether fabric is suitable to manufacturing process. Should Abacus be required to test such fabric, it shall so advise Customer, and Customer shall be responsible for all costs associated therewith.

Fabric yardage requirements will be advised by Abacus. An additional charge may be made to cover the cost of cutting, matching or sewing unusual or directional patterns. Abacus shall have no responsibility for condition, quality, performance, physical properties, or any other aspect of COM.

Abacus reserves the right to reject any COM deemed unsuitable.

Abacus reserves the right to cancel an order at any time if COM is, in Abacus’ sole discretion, inadequate for any reason.

Fabric pilling is NOT a fabric defect or fault, nor does it indicate poor quality. It is a natural characteristic of most fabrics and not covered under warranty.

Abacus and its upholstery divisions warrants upholstery fabrics for one (1) year against seam slippage, and fraying, only if industry standard cleaning methods have been adhered to. This warranty does not cover wearing, wrinkling, fading, nap loss, pilling or fabric that has been treated by an end consumer. Furniture and accessories manufactured by other companies shall have only those warranties of the manufacturer. Warranty service to these products shall be at the discretion and rendered by the manufacturer.

OUTDOOR FURNITURE

Abacus offers products designed for use outdoors.

Outdoor furniture must be stored or protected during inclement or extreme weather such as extreme cold, extreme heat, or excessive wind.

Furniture and accessories manufactured by other companies shall have only those warranties of the manufacturer.

Warranty service to these products shall be at the discretion and rendered by the manufacturer.

Original bill of sale must be presented for warranty or service.

Warranty applies only to furniture subject to normal use and not to defects that are the result of negligence, misuse, or accidents.

 


 

WOOD FURNITURE 

PROPER CARE

The fine furniture you have purchased from Abacus has been designed and built to last a lifetime.

However there are a few simple things you should know to help protect your investment.

All solid wood furniture will expand and contract with changes in humidity.

Try to maintain fairly constant humidity of around 35 throughout the year.

The use of a humidifier in the winter and an air conditioner in the summer is recommended.

Avoid placing furniture close to heat sources and in sunlight, this may cause discolouration, warping or the finish to crack.

Use place mats or trivets when utensils are placed on the wood surface.

Do not place hot items directly on surface.

Do not use nail polish remover, hair spray, perfume or other petroleum based products near the furniture.

STAIN AGREEMENT

We will attempt to match your stain colour from our sample stain board or a sample you have provided. Many factors cause the colour or presentation of the wood to appear a shade darker, lighter, or varying shades of red or brown, etc.

Unknown original stain colour, different woods, grain and density, age of wood and colour, humidity and temperature will cause colour to vary. We do not guarantee colour matching from previous Abacus orders.

I will accept a colour/grain match as close as possible and I realize that the match may not be exact.
